  The EU’s decision to grant Ukraine and Moldova a candidate country status and the recognition of Georgia’s European perspective in June 2022 has significant effects for both the EU’s enlargement and security and defence policies. So far, ‘hard’ security issues have played little role in the framing of the European Neighbourhood Policy (ENP) and the Association Agreements (AAs) with Ukraine, Moldova and Georgia. Their full integration into EU security and defence arrangements will thus require considerable strategy-making and implementation efforts. This article discusses the extent to which existing external Differentiated Integration (DI) constellations can be seen as ‘building blocks’ for Ukraine, Moldova and Georgia’s prospective full integration into the EU’s security and defence architecture. It is shown that, in legal and practical terms, such DI constellations are conducive to the deepening of these countries’ integration with the EU in the security and defence domain. From the political viewpoint, the focus on DI with the new accession countries may, however, be (mis)used as a substitute for fullscale integration into the EU security and defence architecture. We, nonetheless, suggest several pilot domains that can be used to test the limits of new accession countries’ DI with the Union.

  Resilience of local communities (territorial hromadas) is an increasingly salient matter in the academic and policy debate on the factors which have determined Ukraine's resilience to Russia's 2022 invasion. Building on existing literature on institutional resilience and its predictors, this article explains the ability of Ukrainian self-governed municipalities to withstand the threats to institutional stability stemming from the invasion. First, it uses an exploratory qualitative design to operationalize the concept of resilience and its predictors with an account of varying experiences of Ukrainian hromadas during the full-scale invasion (e.g., hromadas near the frontline and in the rear). Next, it presents data from open sources and the results of a regression analysis to test the impact of various groups of predictors on hromadas' resilience to the full-scale invasion. Our models show a significant relationship between hromadas' resilience and geographical, politico-administrative and economic predictors influenced by the outcomes of the decentralization reform conducted in Ukraine since 2014.

  This article dismantles the popular myth that the strategic framing of the EU’s trade with Russia following the 2014 ‘Ukraine crisis’ was nurtured by the liberal peace logic, and the 2022 Russian invasion of Ukraine should be thus seen as an ultimate failure of a ‘liberal peace’ hypothesis. To challenge this argument, we provide a nuanced conceptualization of the trade-peace and trade-security nexuses in EU trade policy and apply it to the case of EU-Russia trade relations (2014–2022). We find that the trade-peace and trade-security nexuses in the EU’s framing of its approach to Russia has been shaped by the bargaining and restrictive logics. Though the case of Russia’s war against Ukraine does not immediately refute the liberal peace theory, we call for the critical reconsideration of the connections between peace and security concerns in the strategic and legal framing of the EU’s trade policy.

  The heterogeneity of the Eastern Partnership countries’ cultures, political regimes and foreign policy aspirations has been a challenge to the EU’s formulation of a coherent umbrella policy towards the region since the 2004 enlargement. Document analysis with a focus on region-level documents and the cases of Ukraine and Azerbaijan demonstrates the EU’s tendency to shift from an emphasis on European integration and common values to the sustainable development concept in order to address this challenge. By also taking into account the context of this tendency, this analysis highlights the need to balance sustainable development, integration efforts and democratisation in the Eastern Partnership amidst increasing differentiation between target countries and geopolitical pressures.

The Symposium seeks to explore a complex interplay between international and domestic law in post-Soviet countries both before and after Russia’s full-scale invasion of Ukraine on 24 February 2022 with a focus on Ukraine and Central Asia. The introduction conceptualizes the term “troubled nexus” and presents an overview of relevant country-specific discourses, policies and practices of international law. This shall offer a reader a sound theoretical and contextual basis to proceed with reading individual contributions in the Symposium.

  Russia’s full-scale invasion of Ukraine on 24 February 2022 can be seen as a culmination of eight years of its aggression against Ukraine, including its annexation of Crimea in March 2014 and the control of the two ‘People’s Republics’ in Donbas. Before the invasion, the Ukrainian authorities had actively expressed their politico-legal stance on the conflict, using lawfare against the Russian Federation, e.g. at the European Court of Human Rights (ECtHR), the International Court of Justice (icj), and the International Tribunal of the Law of the Sea (itlos). In this context, the paper explores the interplay between Ukraine’s domestic legislation regarding the annexation of Crimea and Russia’s control of the People’s Republics in Donbas prior to the invasion, and Ukraine’s use of lawfare against Russia with a focus on policy and legal coherence. It is demonstrated that, while Ukraine’s lawfare strategy regarding Crimea had been in line with domestic legislation, Russia’s use of proxies in eastern Ukraine and the challenges of the Minsk peace process led to incoherence between Ukraine’s domestic laws and its use of lawfare. Though Russia’s 2022 invasion of Ukraine is a game-changer, both for Ukraine’s domestic legislation and its use of lawfare, the analysis contributes to an understanding of the nexus between domestic and international law in Ukraine prior to the invasion and explores the implications such a nexus will have for Ukraine’s future lawfare against Russia, including the most recent icj case relating to the interpretation, application, and fulfillment of the 1948 Genocide Convention.

  Association Agreements between the EU and third countries lie at the heart of the EU’s foreign policy. The Association Agreements the EU concluded with Eastern Neighbours and the Caribbean Forum and Central American countries are marked with partner countries’ ambitious obligations, and the multi-instrument toolbox the EU applies to ensure partner countries’ compliance, including official consultations and dispute settlement. Nevertheless, the EU has demonstrated to prefer informal compliance instruments, such as statements or informal meetings in both the ‘integration without membership’ and ‘development’ contexts. The article focuses on the rationale behind the EU’s preference for ‘soft’ compliance instruments. It isdemonstrates that the European Commission and Delegations may in many cases prioritize partners’ commitment to and ownership of change over a particular result (compliance), despite being able to make use of the asymmetries of its power relations with partner countries. The confluence of the EU’s or Member States’ strong interest in a partner country’s compliance with a specific obligation and the persistence of non-compliance will, nonetheless, lead to the recourse to formalized compliance mechanisms. The focus on the management perspective of compliance in isolation from formal enforcement mechanisms is presented as hardly possible, notwithstanding the EU’s quest for ownership.

  External differentiated integration constellations, such as the EU Association Agreements (AAs) with Eastern Neighbours, require third states to conduct extensive regulatory approximation with EU rules. Nevertheless, compliance in EU external differentiation remains under-researched. In this vein, the article explains (non)-compliance in EU external differentiated integration through the prism of an integrated approach to compliance that brings together the enforcement and management perspectives. The research is based on the case study of Ukraine's fulfillment of its transport- and infrastructure-related obligations under the EU-Ukraine AA. It is found that Ukraine's low compliance rates stem from an array of factors attributable to both of the applied perspectives. The study testifies to the complementarity of the enforcement and management approaches in the research of compliance in EU external differentiated integration and points out the need for the Commission to combine ‘carrots-and-sticks’ approach with consultations and capacity-building to strengthen Eastern Neighbours' compliance with AAs norms.

  The EU-Ukraine deep and comprehensive free trade area (DCFTA) is marked by an impressive scope of regulatory approximation and market integration. Nonetheless, the performance of the DCFTA often tends to be assessed through the sole prism of changes in the volume of trade between the parties. This paper seeks to complement such an approach by an in-depth investigation of EU-DCFTA’s performance from the efectiveness and impact perspectives. It fnds that the EU-Ukraine “deep” trade agenda is marked by medium efectiveness, with the strongest concerns, attributed to corruption, weak rule of law and strong oligarchic infuence. At the same time, the DCFTA had been a strong engine for trade-related reforms (e.g. countering technical barriers to trade; public procurement; competition and state aid) in Ukraine over the period from 2014 to 2019. Yet, the reforms’ tempo slowed down after the most recent presidential elections, with numerous changes pending in the domains of transport and infrastructure, fnancial sector reform and customs reforms. Nonetheless, the EU-Ukraine DCFTA is found to exert a considerable impact on the interplay of the regulatory spaces and infuences in the regions and the role of the EU as a trade power.

The lecture introduced students to the peculiarities and dynamics of EU media systems and compared them to the developments pertaining to the media system in Russia amid Russia's war against Ukraine. The lecture also compared and contrasted the EU's and Russia's narratives about the war, its parties and reasons.

  The book offers new insights into how ethnicity, language and regional-local identity interact within the context of Ukrainian political reform, and indicates how these reforms affect social cohesion among ethno-cultural groups. While the individual chapters each focus on one or a few facets of the overall research question, together they draw a nuanced picture of the multifaceted challenges to creating and consolidating social cohesion in a nationalizing state. The concept integrates various disciplines, including political science, international relations, law, and sociology. Correspondingly, the contributions are based on various methodological approaches, ranging from legal analysis over media discourse analysis, individual and focus group interviews to analysis of data from a representative population survey. The findings of the in-depth study are discussed within the broader context of comparative research on diversity management and social cohesion in fragmented societies.
