Prerequisites

The admission requirements for the Executive MBA is a completed bachelor's degree or equivalent education consisting of at least 180 ECTS and a minimum of two years relevant work experience after the completion of the education.

Relevant work experience is herein work experience within management or work experience from other positions with independent responsibilities.

Recommended prerequisites

Good knowledge of the English language is recommended.

Supply Contract Forms
- General: use of standard forms 
- Structure of contract - standard industry forms (e.g. LOGIC and NF/NTK)
- Turnkey and "back to back" principles
- Choice of law - implied and mandatory provisions 

Key Terms
- Delivery terms and retaining/passing risk and title (INCOTERMS)
- Delay and Liquidated Damages (dagmulkt)
- Liability regimes (knock-for-knock models)
- Gross negligence and wilful misconduct
- Consequential Damages (indirekte tap)
- Termination (force majeure and frustration) 

Payment terms and financing
- Letters of Credit (UCP 600)
- Security (parent and bank guarantees)

Chartering
- Charter types (voyage, time, bareboat)
- Standard industry forms: BIMCO (e.g towcon, supplytime)

Purchase and new buildings
- Norwegian Saleform (Memorandum of Agreement for second hand sales)
- New BIMCO shipbuilding contract
- Traditional forms: SAJ (Shipbilders Association of Japan) and AWES (Association of Western European Shipbuilders).

Learning outcomes

The student is to
- acquire knowledge about different standard contract that are used in conjunction with offshore projects
- acquire awareness of key risks in contractual relationships and how risk is divided between partners
- gain insights into distinct challenges associated with contracts dealing with international activities

Examination requirements

Individual assignment must be approved.

Teaching methods

Lectures and group work at two sessions within the semester, each of them consisting of three two-day sessions. Net based teaching through Canvas.

Evaluation

The person responsible for the course, in consultation with the student representative, decides the method of evaluation and whether the courses will have a midterm- or end of term evaluation, see also the Quality System, section 4.1. Information about evaluation method for the course will be posted on Canvas.

Assessment methods and criteria

A one week exam at home, individual or in groups (max. 3 people) The grades A-F are used (ECTS grading scale).
