Siri-Helen Egeland is an assistant professor at the Department of Law at the School of Business and Law, University of Agder. She holds a master's degree in law from the University of Bergen.

Egeland`s work background is mainly as a lawyer in the private sector. Here, she has worked widely with business law, with the main emphasis on the fields of contract law, public procurement, real estate and dispute resolution. She also has experience as a senior legal adviser in a consultancy firm, where she assisted consultant engineers with procurement processes on behalf of clients, as well as project management and construction law.

Egeland has always been interested in intellectual property law and copyright law in particular, and is currently working on a PhD project focusing on copyright, visual art and technology.

The English artist Banksy has recently faced trademark proceedings at the European Union Intellectual Property Office (EUIPO). Indeed, Pest Control Office Ltd., the official handling service which represent the artist, has filed in the past years several applications with the EUIPO, and obtained registrations, for various signs which incorporate some of Banksy’s most iconic pieces. Unfortunately for the artist, some of these registrations have been cancelled because the applications have been considered as filed in “bad faith". This short note first discusses the string of cancellations that Pest Control faced at the EUIPO. It then addresses the development that took place in October 2022 when one of the cancellations (the one related to the figurative trademark “monkey holding a placard”) was annulled by the EUIPO Fifth Board of Appeal on the grounds that the filing was not proven to be done in “bad faith”. Finally, the note looks at other jurisdictions where Pest Control has registered trademarks, before concluding with a short comment on how issues could be handled in the future by Banksy and his organisation to avoid the headaches suffered in these latest years.
